Based on will never modify a noun nearest the clause...

It should be replace by on the basis of or using the records of...

Examination of and on the basis of...

B

Eliminated A C E because of the use of 'based on'. I thought you can say
a report is based on xxx (evidence), and you would say the judge denied his retrial request on the basis of lack of new evidence.

Between B and D, the difference is between like and such as

such as is used to indicate examples
like is used to show similarity

Eliminated A, C & E because of the usage of 'based on'

Eliminated E because it uses 'like' (comparison)
