The main sentence can be re-written as (after removing the modifiers and un-necessary parts)
Controversial mortgage laws passed last year state that, if during the loan period person is not able to meet the payments, that person’s spouse ______ the balance.
It is kind of complete the sentence now. The point to note here is that. Person failed to make payment so only thing spouse is responsible for should be payment and nothing else, however statement 1 (original statement talks about other responsibilities so it is out).
Moreover the correct sentence should be referring to some future tense. So C & E is out.
"For Paying" is more appropriate than "To Pay", I will say more idiomatic.
So I will go with D.

If condition describes hypothetical construction then " then clause requires Will + Base Verb” structure. However, the given sentence is about a law – not a hypothetical condition.
Eliminate A, B and D
Between C and E:
E – unidiomatic (to pay is more idiomatic than for paying) PLUS C appears more parallel than E.
Answer: C
A will have responsibilities that include
B will be responsible to pay
C is responsible to pay
D will be responsible for paying
E is responsible for paying
