Incidentally, the H1B exploitation is rampant amongst small Indian consulting firms. In fact, recently one of the employees of a mid-size firm filed a complaint stating that he was underpaid. The exploitation process is made possible by a small loophole in the LCA ( Labor clearance ) approval. I don't know the details but perhaps immigration attorneys are well aware of this process.

This brings up a question. Should H-1B visa worker be paid less than their US counterparts. Before I get Flagged I'll produce both arguments that I believe are the fundemental question.

ARGUEMENT 1) H-1B visa internationals typically have to work a little harder to even get the job, and perform at the same level therefore EQUAL WORK = EQUAL PAY

ARGUEMENT 2) Companies typically have to pay fees just to hire a H-1B Visa, as well as extra paperwork and a longer procedure, I've heard 10K, so they should therefore make 10K less than their US counterpart.
Cost US = Cost International - Cost H-1B.

Any opinions?

Argument 2 - Valid only if the first year pay for H1B workers is lesser by 10K as compared to domestic workers. The H1B expense is a one time expense for the company.
