H1B to F1-PLease help [#permalink]

Hi Guys,
I have a situation on ohand and would like to get your valuable advice. I am currently on H1B and when I spoke to my company regarding the Green Card, they said they would be happy to do so. But I plan to apply to my MBA starting fall 2008. Since I do not think the GC will be processed before 2008, I am planning to apply for GC through my wife (who is on H1B) and apply for a F1 visa when starting my MBA.
I am inclined to do this as I predict to have the GC processed for my wife (and ultimately me) by the time I finish with my MBA.
I need your advice on how to proceed with my situation.

Are you asking if you should have sponshorship through your employer or through your wife?

Yes Ryhme...also do you think it will be a fairly straightforward process to move from H1B to F1 when i start school.

Yes I dont see any reason why it shouldn't be. You are going from earning $$ to paying $$ and uncle sam would be glad to see this!

I would recommend that you consult a lawyer.
You may already be knowing that F-1 and GC dont go hand-in-hand. As a student on F-1, you present an intention of returning back to your country, but if you have already applied for a GC (even through your wife), it will hurt your chances of getting an F-1, as that contradicts your intentions. The farther you are in the GC process, the more it will hurt.
The safest thing would be to let your wife apply for GC, once you have a F-1. Again, I am no expert on visa stuff (but I am in a similar situation as yours), so, I would recommend you seek advice from a lawyer.
