A. both the Federal Trade Commission and the Commerce Department is planning to release independent, and possibly conflicting, Subject is plural - so we need are and not "is"
B. the Federal Trade Commission and the Commerce Department are both planning to release independent, and possibly conflicting,both is modifying planning instead it should modify the 2 departments
C. the Federal Trade Commission and the Commerce Department both are planning to release independent, but possibly conflicting, Same problem with - both as in {B}
D. both the Federal Trade Commission as well as the Commerce Department are planning to release independent, and possibly conflicting, it should be - both the X and Y, no need for as well as in between
E. both the Federal Trade Commission and the Commerce Department are planning to release independent, and possibly conflicting, This one makes sense, both is modifying the FTC and the CD, Verb - "are" satisfies the plural verb.

AND needs plural verb while AS well AS needs singular verb. eliminate A,D. B. Placement of both is incorrect. Eliminate. between C and E, placement of both is better in E. Moreover, C uses Independent, but Conflicting. Hence E wins.
