For (D), the state has set up a rule with the intent etc.
Isn't "with the intent" modifying "the state"?

I think in (D), with the intent is actually modifying nurses.

the usage of intend could be active or passive.
So, A, and C are OK. but put through traige should modify patients, so choice C ,modifying emergency room,is wrong.
In choice B, the lack of the that following ensure makes the sentence awakward.
(D) "with" can modify any preceding noun.
(E) "this" has no referent.
Therefore, ans is A.

--> fine.

---> we need "that" after "ensuring" for B to be correct! Also, the position of "at least" is incorrect! --> out. Also, "with the intent of" right after "rules" makes that intention be of the "rules" --> out
C. rules intending to ensure at least one nurse is assigned for every four patients in a hospital emergency room put through triage
---> the use of "intending" right after "rules" make "intend" become an act of "rules" . Also, we need "that" after "ensure" --> out
D. with the intent of ensuring that at least one nurse should be assigned for every four patients in a hospital emergency room that are put through triage
---> what "are put through" is the "patients" , not the "emergency room" --> out
E. and this is intended to ensure one nurse at least to be assigned for every four patients put through triage in a hospital emergency room
