Many schools do offer a waiver but do not mention it clearly on their website due to large inconsistencies among schools/ universities in countries where English is not the native language. Take India as an example, almost all universities would claim the instruction language as English. How many candidates do you think pass the bar that is required?
There is no clear answer and that is exactly why there is a requirement of a standardized test. At the same time, if you have any documentary proof of your abilities, they may give you a waiver. For instance, I have shown my earlier TOEFL score (112/120 : now expired) and an article published in an international science journal as a proof of my language abilities."
It also largely varies from university to university on what is considered as a substantial evidence for a waiver.
