The ABC company apoligized to the court for <failing to/its failure to> properly submit XYZ during the last decade.

Which one is correct and Why? (I do not recall the question precisely but I do know the answer).

Its a kind of idiomatic expression and proper usage:- "its failure to" is better than "failing to".
