I think A is fine.

'...accused of having illegally taped...and then used...' is parallel.

OA is D ..
Can somebody explain what does "they" in D refer to .. is it police ... and if it is indeed ... is Police singular or plural ..

D makes it seem as though the defense lawyer first suspected the police of taping confidential conversations and then suspected the police of using that information.
But...well!
