Even though it was not illegal for the bank to share its customer's personal and financial information with outside marketing company in return for a commision on sales, the state's attorney general accused the bank of engaging in deceptive business practices by failing to honor its promise to its customers to keep records private

Here is my two cents..

if you read the sentence as

the state's attorney general accused the bank ....... by failing

this construction sounds good.

For other choices, B, C

.... bank .... by its failure

D, E
.. and bank .... because of its failure...

are ackward construction.
Hence its A

I think its A. There is nothing wrong with the sentence and any of the other choices don't offerr any better alternative.

its - who does its refer to?
C)in its failing to honor its promise to its customers of keeping
"in its" - wrong usage
D)because of its failure in honoring its promise to its customers in keeping

E)because of its failure to honor its promise to its customers of keeping
because is wrong

I think "of keeping " in E makes it an incorrect answer choice.
