Here is my two cents..
if you read the sentence as
the state's attorney general accused the bank ....... by failing
this construction sounds good.
For other choices, B, C
.... bank .... by its failure
D, E
.. and bank .... because of its failure...
are ackward construction.
Hence its A

I think its A. There is nothing wrong with the sentence and any of the other choices don't offerr any better alternative.
