A & B: have been is wrong. there is no time mentioned since when they are allowed to build. Also TINT AMOUNT in choice B is incorrect usage.
C & E: "will" changes the meaning as it brings crtainty that new law WILL increase the amount. however original sentence says new law WOULD do so. it is the expectation not 100% sound prediction.

D : would retains the meaning. "ARE" is correctly used.
