can someone please explain A vs E??

There are lot of old posts discussing this question, but I think our community has evolved a lot since then ...

A - uses "instead of" which is used when one thing is replaced with a different one.

E - uses "rather than" which is used to show preference.

Judge Bonham denied a motion to allow members of the jury to go home at the end of each day instead of to confine them to a hotel.

Tip: Gmat prefers "rather than" than "instead of". A, B , C out. Although, i did consider motion that... as correct but
after considering both the above points only D has both but then D has parallelism error.. allow (verb).....confinement (noun) in

Now in E..to ..allow..[to] be confined is parallel and it also uses rather than...

Hi ratinarace,

The first thing that differentiates E from A is the use of "rather than".

"rather than" expresses a preference, whereas "instead of" expresses replacement

Moreover the "of" in instead of is a preposition, so "instead of" should always be followed by a noun, whereas "rather than" is used to compare nouns and verbs, so you can use nouns and verbs after rather than. In GMAT 'rather than' construction is more likely to be correct. If at all you have to guess, then guess the one with rather than in it.

e.g.

I would prefer to go to school rather than sit idle at home

I wanted to play football instead of hockey.

In (E) "Judge Bonham" denied a motion that gives one activity preference over another.
