Parallelism and D wins, though the repetition of 'his' is rather unnecessary.

A - introduces because - we already have on grounds of ...

B - C are just plain wrong :/

E - combine - him being vs his being one more odd point.

A) atheism, because he was immoral in behavior, and his ...use of because is wrong here

B) atheism, immorality in behavior, and his...immortality..and his radical politics not parallel

C) atheism, his immorality in behavior, and... immortality,...and radical politics not parallel

D) atheism, his immoral behavior, and his ...correct....

E) being an atheist, immoral in behavior, and having ...wrong use of being and having

B -> immorality in behavior is not parallel to his atheism and his radical politics - WRONG
C -> radical politics is not parallel to his atheism and his immorality in behavior - WRONG
D -> his atheism, his immoral behavior, and his radical politics are parallel -> CORRECT
C -> his being an atheist is not the right construct - WRONG

When his wife committed suicide, Shelley was denied custody of his children on the grounds of his atheism, because he was immoral in behavior, and his radical politics.

A) atheism, because he was immoral in behavior, and his - Incorrect Parallelism

B) atheism, immorality in behavior, and his - 2 issues here, incorrect parallelism but also, the immoral has changed into an adverb not modifying anything

C) atheism, his immorality in behavior, and - Adverb modifying nothing

D) atheism, his immoral behavior, and his

E) being an atheist, immoral in behavior, and having - all of this just sounds wrong, not quite sure why

IMO D.

The sentence is an excellent example of parallelism and only option D complies with the same.

Explanation:

A) atheism, because he was immoral in behavior, and his
'Parallelism error'.Atheism,immoral behavior and radical politics are list elements here and must be parallel in structure."Incorrect"

B) atheism, immorality in behavior, and his
'Parallelism error', adverbial modifier immorality incorrect here.

C) atheism, his immorality in behavior, and
'Parallelism error' .As hinted by non underlined part either you need relative pronoun reference "his" before every list element or you may apply ellipsis and use "HIS" already present at the start of list only once.There is no way in between (its Binary-Yes OR No)

D) atheism, his immoral behavior, and his
Correct.Proper parallelism giving clear meaning to the sentence both logically and grammatically.

E) being an atheist, immoral in behavior, and having
'Parallelism error' wrong usage of Being and Having.

Hence D is the correct answer.

Note: Correct parallelism will be "on the grounds of X, Y and Z" or "on the grounds of his X, his Y and his Z" -- no other mix-and-match combination.

A) atheism, because he was immoral in behavior, and his -- parallelism is not mentioned and "because" conjunction is introduced smack in the middle making the sentence wordy

B) atheism, immorality in behavior, and his -- reason mentioned above

C) atheism, his immorality in behavior, and -- same as B

D) atheism, his immoral behavior, and his -- CORRECT

E) being an atheist, immoral in behavior, and having -- unnecessary amalgamation of gerunds and adjectives.

The answer should be D

Immortality- never dying is very different from immoral (dishonest, vicious)

Only D wins the battle.

Oh, I understand. My intention in pointing it out was to highlight that we should not consider the presence or absence of a word as the elimination point as we are normally thought. I appreciate your thought process and explanations very much.

Yes, there are such patterns that are not universally true. Case in point, the lesson learnt from my one of the first questions here, where does not always refer to a place.
