X & Y need to be in present tense cause they are facts even though the whole event happens in teh past.

OA is D.

I originally went with E because I remembered a rule that said that scientific theory is presented in the present tense unless it is shown to be false. However, I guess that the need for "orbit" and "is" to be in the same tense is overriding in this case?

Good question, I originally went w/ E as I thougth the sentence was in the past, but good point about the scientific theory begin in the present unless proven false.
