So we need an option that should add some more point to say that legislation is needed to regulate the open-air fires.

The purpose of the legislation is to limit the health risk posed by woodsmoke. Poor air quality is a health risk, so choice (E) is evidence that regulation of wood-burning would help limit the health risk in those valleys. This supports the conclusion that "legislation is needed to regulate the use of open-air fires and wood-burning stoves."

In my opinion the word Proposed has been used just to modify or talk about the legislation passed, in other words the legislation which will come in effect whenever necessary. This removal of this word does not influence the answer choice. Moreover, this choice acts as a weakener instead of strengthener because if heating is done with oil or natural gas then there is no point talking about smoke from wood.

Besides, the statements above the stem are premises, so if this were the answer choice (which is a counter) there is no premise to help the same.
