adverb "both" is misplaced in A, B, and E, so we can quickly eliminate. also the verb "used" should stay next to its subject 'institution used' not 'institution both used'

again for D "both" is misplaced. deceptive is describing the lending.

so my answer is C

by the way, the underlined portion should be fixed

C - 'used both' is the only logical way.

I hate such type of questions, because my hit rate decreases to 50% on them

The answer is E

Banking regulators have seized a savings bank in Georgia and charged that the institution both used deceptive lending and business practices and it misled its stockholders.
A. both used deceptive lending and business practices and it misled (both used...it misled=>not parallel=>OUT)
B. both used both deceptive lending and business practices and that it misled (it is clear without explanation=>OUT)
C. used both deceptive lending and business practices, misleading (contender, I think that there is nothing misleading in using business practices=>OUT, other explanations why C is wrong are highly appreciated)
D. used deceptive both lending and business practices, and misled (deceptive is adjective which should modify lending=>OUT)
E. both used deceptive lending and business practices and misled (both used...misled=>OK)

Placement of 'both' was confusing me in A,B,D, and E. but the 'used' and 'misleading' are not parallel so C wasn't fitting.....I had only one problem with E that is placement of 'Both'.
I dont know the specific rule but my gut feeling says that placement of 'Both' in E can be right. So E is my choice.

If somebody know the specific rule, please write.

Its between C and D.
I think its D .
First : "used" and "misled" are parallel .

Second : In C used and misleading are not parallel

Third : C coveys that bank used "deceptive lending" and "business
practices". It doesnt convey the practice was deceptive .
D does that correctly saying both lending and business practices were deceptive.

It is the only parallel construction.

I say D.

It's still parallel: "used [blah], and misled [blah]..."

The word both should be used to "wrap" the "deceptive lending and business practices" part as one.

In E, "both" is unnecessary. In fact, it makes it illogical.

Just my $.02. Whats the OA?

OA is E :)
OE according to the book is:

"There are parallelism errors with the correlatives both ...and...in choices A and B. Choice C, though grammatically correct, changes the meaning of the original sentence slightly. Choice D awkwardly separates the adjective "deceptive" from the words it modifies."

The source is "Cliffs verbal review for standardized tests" . Btw, I find this book pretty good :)

I had picked C but after reading the OA, E makes sense primarily because: we don't need 'both' in choice C. In fact, using 'both' makes choice C wordier and if we omit it the meaning will be conveyed correctly.
