OA is E. but i have a question. is "are warned" present or past tense?? i do know it's passive, but how should this be interperated exactly?

The problem with answer b is that the verbs "must be warned" and "evaluate" are in present tense, while the federal rules were established (in the past), and the last part "before it was concluded" require that all verbs in the sentence must be in past or past perfect tense.


"are warned" is the present passive voice; "were warned" is the past passive voice, and "will be warned" is the future passive voice
