In 1925, the Supreme Court declared the law banning private schools in the state of Oregon as unconstitutional, and ruling that while the state was free to regulate private schools, it could not eliminate them.

A. the Supreme Court declared the law banning private schools in the state of Oregon as unconstitutional, and -- We must remember that a present particle after and, is mostly suspect; Unless it is matched by yet another present participle before 'and', it is bound to end as an unparallel fragment.

B. the Supreme Court declared as unconstitutional the law banning private schools in the state of Oregon, and --- The same issue as in A.


C. the Supreme Court declared unconstitutional the law banning private schools in the state of Oregon, --- The correct choice

D. the law banning private schools in the state of Oregon was declared unconstitutional by the Supreme Court, ---Change of meaning that the law made the ruling rather than the SC.

E. when the Supreme Court declared the law banning private schools in the state of Oregon as unconstitutional-- it is not clear who could not eliminate them, whether The SC or the State or the law.

Sir, I feel that C is really awkward. Shouldn't it be the Supreme Court declared the law banning private schools in the state of Oregon unconstitutional
Furthermore, in (D), the subject of modifier ruling .... is law. I feel the law can be the subject for this action.

I can’t see what is awkward about C.
What is banned? it is the law. Therefore what is the harm in putting them together? Your version gives the feeling that it is the schools that are unconstitutional.
In D, if you make the law as the subject, then you have to put it in a passive voice sentence. Will it be better than C, which is in active voice?
