At first I thought that option D is the correct one, but then I remembered -
In many weaken questions, I have read that the option choice which talks about that "the same plan didn't work in the past" is never chosen the correct answer, and it is reasoned that "something that has occurred in the past, it doesn't necessarily mean that it will occur this time too". Yet in this question the same answer choice is accepted.
I am not sure what to do in weaken questions anymore!

The reason D) works because the past cases used the same mortgage structure and failed through the exact mechanism that threatens this plan: rates rose, borrowers stopped paying, and homes became vacant again.
The rule you remembered is too absolute - perhaps that was in the Must Be True Question? I would be curious of an example if you have one so I can answer better.... I don't seem to recall these types of questions....
Looking at this question, you can argue that past failure does not prove that a plan will fail again, but a weakener does not need to prove failure. Closely comparable past results can make the proposed outcome less likely, especially when they reveal a specific flaw in the plan.
