Correct choice since the government will not do anything that will harm its strongest support ie the labour union.WHile the union may not be aware of the adverse effects of the new regulation,it will eventually experience adverse effects whatsoever and will remove its support of rthe government.
B. whether any unions might benefit from the new workplace regulations
Analysing the possibility of union benfiting from the regulation is not relevant since even if it do benefit the passing of the regulation will be benficial to maintain the support. and if the regulation does not benefit the labour union explicitly it will still support the goverment.
C. whether the state legislature needs leadership’s support to pass the new regulations
The leadership support is out of scope as it is not impacting the point in discussion
D. whether the labor unions have publicly spoken out against the proposed regulations
While the labour union supports the govenment it may not speak out publically or it may do,but the government must know the opinon of the union,wether it may be publically or it may be implicit.

Not sure if you are active. But how can you say that "the state legislature" is out of scope in Option E. It is very much in scope of the argument.
