"The pharmaceutical company must" is the key part of the sentence. It must do two things:
1) report the number of casualties; and
2) release the statistics

Both verbs are thus present tense.

Hi guys!

IMO D

A. suffered by its test subjects and that the statistics be released wordy and also, it uses unneeded pasive voice
B. that its test subjects suffered and that the statistics be released the first part could be, but the second part (which is that the statistics be released) do not follow the structure with must
C. that was suffered by its test subjects with the statistics being released pasive voice, being...
D. suffered by its test subjects and release the statistics hold
E. suffered by its test subjects and released the statistics relesead do not follow the structure with must

OA?

i was misled by the verb suffered.. it has to be parallel with report.. thanks

What's wrong with A? Doesn't the latter half of the sentence require subjunctive mood?

In A, the sentence is like this "The pharmaceutical company must report to the FDA that the statistics be released to the public". Does it make any sence? Report that is wrong. It lacks parallelism, that why the OA is D.
