A maintains the parallelism and the correct placement of modifier.

That conjunction inserted in A restricts the scope of the "act of congress". It modifies act that made provision that E fails to establish.
Also the use of gerund "establish-ing" is not true and makes the sentence structure awkward.
Thus A is the best choice.
