A. The suspect robbed the bank.
(Can't say, it wasn't mentioned that he "robbed", also he could have just started to shoot at the policemen out of anxiety) -> Rule out.

B. The suspect was not as good a marksman as were some of the police.
(If that's the case, why did policemen take the cover?) -> Rule out.

C. The suspect’s accomplices, all armed with guns, were in the waiting car.
(Nothing was mentioned about the people inside the car, again, it could be any taxi as such, which in turn left the scene after hearing the "shooting") -> Rule out.

D. If the suspect had not been hit, he would have fled the scene in the car.
(He was about to get in the waiting car, if one policemen hadn't shot him, he would have probably left the place) -> Keep it.

E. The police were trying to kill the suspect. (Can't really state it, maybe if that's the case, policemen could have aimed and shoot for a headshot. Anything could have been the case.) -> Rule out.

Therefore, Option D is the correct choice and we could infer from the above scene.

I think the correct answer is B as we cannot intuitively rule out this option
