(1) alone is sufficient.
Using phytagora: we get that AC must be equal to 5 if the triangle is a right triangle. Therefore, we know that the triangle cannot be a right triangle.
(2) alone is sufficient, too.
The triangle is isoscele => AB=AC or BC=AC.
Using Pythagoras again, we can see that the triangle cannot be a right triangle.
Hence, D.
