ok guys, this is off topic.. but this applies to anybody who was on F1 visa in USA then went to OPT and then H1B..
my "tax" situation.. I was on F1 (OPT) from august 06 - August 07. H1 kicked in from October 07. so for tax year 07, I was on OPT for 8 months and H1B for 4 months.
I am filing my taxes and after munching on google, tax forums and even KPMG's tax associates (no help).. i am lost
What I want to know is the following
Since I was on OPT upto August 07 - do I use the 1040 NR form for non residents
or since I started on H1B from Oct 07 - do I use the 1040 EZ form for residents.
I talked already to dosa, (the god of analytics) who suggested 1040EZ, since the forms themselves are not very different, but I just wanted to "corroborate" (KPMG audit lingo - blehhh) my findings.

I'm no expert but isn't difference between 1040NR and 1040EZ is how you claim your deductions, itemized or standard, nothing to do with immigration status. I'm not sure though.

What was your visa type during September 07? I ask this because my wife will have two months gap between OPT ending and H1 starting and HR advised her to go on vacation to India and return in October

under OPT, you can stay legally in USa for 60 days.
There is no need for ur wife to go to India, unless she needs to get her H1B visa stamped.
She can go to border post US consulates in Mexico and Canada to get the H1B visa stamped.
Also, your wife can enroll in a community college (provided her US F1 visa is valid) and then get a CPT, which all community colleges give out, and work for 2 months using the CPT.
Ok found out that there is no difference in tax refunds between 1040 EZ and 1040 NR EZ..
I am the new tax pimp..
