The way I understand it, they are both active because the verb comes after the subject. I.e.,

The philosopher ABC (subject)........preferred (verb)

The issue is the modifier and not active vs passive voice...

The sentence 2 would have been right if it said
who was born in Germany and who was a naturalized citizen.
