I picked A but C was a strong contender as well. Can someone please explain why C must be eliminated? TIA!

Its reason is that nothing about C is narrated in the paragraph So you can not assume anything by yourself while options A is directly related to the passage and could a possible assumption.

But isn't that what an assumption is? A new information that is not mentioned/narrated in the argument but still relevant to the conclusion?

Yes ! you are right assumption is something which is newly introduced
and all five options are assumption but right is one which is related to the passage

When the state of Tennessee passed a law prohibiting the teaching of the theory of evolution in its public schools, leaders of the American Civil Liberties Union (ACLU) persuaded John T. Scopes, a teacher in Dayton, Tennessee, to teach evolution in his classroom in order to test the law in court. However, because Scopes did not break the law on his own initiative, he should never have been brought to trial.

Which of the following is an assumption underlying the conclusion of the passage above?

A Those who commit crimes at the suggestion of others should not be held responsible for their actions.
B Both Scopes and the ACLU leaders should have been tried for breaking the law.
C The ACLU leaders, rather than Scopes, should have been brought to trial.
D Groups like the ACLU should not encourage criminal activities as a means of testing laws.
E Tennessee did not have the right to make the teaching of evolution a crime.

I was going to pick C too, but then I reasoned. Thin line of difference between A and C:
- A states the assumption by answering why Scopes shouldn't have been brought to court - because he committed a crime at the suggestion of others.

- C says who should have been brought to court instead, but that does not concern us. If C is true, by that logic B could be true too. We don't have enough facts to support who should have been brought to court, we are only concerned with who shouldn't have, hence A and not C.

hope that helps!

I chose A.
Even though we can assume that "the ACLU leaders, rather than Scopes, should have been brought to trial", this assumption is not as strong as "those who commit crimes at the suggestion of others should not be held responsible for their actions" to give a reason that Scope should never have been brought to trial. Moreover, information in option A has more reasonable assumption than information in option C.

I hope that would be helpful.
