While the Internet has tremendous potential to aid in a child’s development, online content that could be harmful or otherwise inappropriate for young children abounds. One attempt to protect children from unsavory subject matter on the Web was the passage of the Children’s Internet Protection Act (CIPA) in 2000. This piece of legislation requires that any schools or public libraries wishing to receive federal funding for computers and Internet access must also procure Internet filters that can block graphic images on any computer to which a child might have access. Given the often limited funding that public libraries receive, especially those in poorer areas, many had no choice but to accept the restrictions imposed by CIPA.
Despite its well-intentioned inception, CIPA is arguably unconstitutional because, in effect, it allows the federal government to limit certain forms of free expression. Given its pervasiveness and accessibility, as well as the opportunity for user anonymity it affords, the Internet provides a unique forum for the promulgation of free speech. All online material that is legal, no matter how unappealing some may find it, is protected by the First Amendment. CIPA is therefore in direct contradiction to the constitutional guarantee of free speech and is not an acceptable means of limiting children’s exposure to questionable Internet content.
