Declare X,Y - is correct idiom usage.
Supreme court declared the new law unconstitutional - CORRECT

Declare X as Y - is Incorrect idiom usage.
Supreme court declared the new law AS unconstitutional - INCORRECT

declare usage :
1) They declare that we are all children of God
2) The painting was declared to be a forgery
