I did not quite understand the solution. Isn't the cook a sailor (with two legs)?
so you get
4C + 2S + 1 = 41 legs
What is the mathematical reason for treating the cook differently?

What is the mathematical reason for treating the cook differently?
Because the problem defines three separate groups: “sailors,” “a cook,” and “a one-legged captain.” So “sailors” excludes the cook by definition.
