I don’t quite agree with the solution. Why is cook not a passenger?

The cook is a passenger, the solution temporarily “excludes” the cook in the first step only to simplify the head and leg count for the remaining group. This doesn’t mean the cook isn’t a passenger; it’s just part of breaking the problem into smaller parts to solve. Please review the solution again.

I did not quite understand the solution. Isn't the cook a sailor (with two legs)?
so you get
4C + 2S + 1 = 41 legs
What is the mathematical reason for treating the cook differently?

Because the problem defines three separate groups: “sailors,” “a cook,” and “a one-legged captain.” So “sailors” excludes the cook by definition.
