Question:
Can Rita claim full protection under Sections 96–106 IPC for causing the death of the robber?

Actually — in this case, the correct answer is A) Yes.


Under IPC (part of Sections 96–106), a person has the right of private defence of property — even to the extent of causing death — when the crime involves:

✅ Robbery
✅ House-breaking by night
✅ Mischief by fire
✅ Theft, mischief, or house-trespass with danger to human life

In this situation:

👉 The robbers were armed
👉 They were committing house-breaking by night (shop = property)
👉 Rita reasonably feared for her life and used her licensed gun

Thus, she acted within her right of private defence — so Section 96–106 protects her.

Its true the question should be given more context....anyways,another question👇

Situation:
Mohit catches a teenager trying to steal mangoes from his garden during the day. The boy is unarmed and tries to run away. Mohit, very angry, hits the boy on the head with a heavy iron rod, causing serious injury.

Question:
Can Mohit claim full protection under the Right of Private Defence (Sections 96–106 IPC)?

A) Yes
B) No

Noo, first of all it’s an offense too get into someone private property but hit from a rod is unusual i mean he could work either way

The force used by Mohit is disproportional to the offensive force of that teenager. So maybe Mohit can’t use the full protection...

should be E, statement 1 tells you nothing since regardless of whether x is positive or negative, x^2 is positive, and statement 2 is also inconclusive since if y = 0 , x can be anything

B) No!


👉 The Right of Private Defence (Sections 96–106) does allow you to protect your property — but your response must be reasonable and proportionate to the threat.

👉 Here:
✅ The boy was unarmed
✅ The theft was minor (stealing mangoes, not armed robbery)
✅ He was running away — no threat to Mohit’s life or serious threat to property
✅ Hitting him with a heavy iron rod causing serious injury was excessive and not proportionate

👉 So Mohit cannot claim full protection under Sections 96–106.
