Why is D so tempting? I am trying to understand how the test writer would have come up this choice to make it attractive? Is there a common trick that GMAT uses and how we can avoid it in other similar questions? Thanks

I am not sure why you find (D) tempting.
Even if everyone knows that legislation is considering the bill, if the bill is not passed, hormone milk will not be labelled 'hormone milk.' Then how will everyone know whether the milk they are buying has hormones or not? If they would not know, why will sale of hormone milk deplete? People must be able to make out the difference.
If the law does not force hormone milk producers to mark it as hormone milk, people may not be able to distinguish. But if clean milk producers can mark their product as clean, then people can distinguish.

I selected option E because i mistook the conclusion and thought it to be as- the dairy farmers who do not use hormone will loose money.
