The commissioner of a professional sports league dictated that teams could not put players on the field who had a greater than 20 percent chance of suffering a career ending spinal injury during competition. The commissioner justified this decision as a way to protect players from injury while protecting the league from lawsuits.

Which of the following, if true, would most undermine the effectiveness of the commissioner’s new policy?

A. Spinal injuries can result in paralysis, loss of fine motor skills, and even death.
B. The previous year, more than seven players in the league suffered career ending spinal injuries.
C. The players’ union agrees that the risk of injury is an inevitable part of playing the game at a professional level.
D. There is no scientifically valid method for determining the likelihood of any player suffering a career ending spinal injury at any given time.
E. Players barred from playing because of this new regulation will be entitled to compensation for lost wages at a level determined by the commissioner’s office.

Clear D.

If there is no way of knowing the possibility in advance, the commissioner's plan makes no sense.

I could not identify the conclusion of the argument.
Is the new policy intended to serve two purposes:
a. To protect players from injury
b. To protect league from lawsuits.

How does D fit in to bill ?

adkikani - D fits into the bill in that it undermines its key assumption: that the players with a high likelihood of injury can even be identified. If they can't, there is no way to ban the right players.

Let's review the answers:
A. Spinal injuries can result in paralysis, loss of fine motor skills, and even death. This stresses the importance for the plan, doesn't undermine it
B. The previous year, more than seven players in the league suffered career ending spinal injuries. This stresses the importance for the plan, doesn't undermine it
C. The players’ union agrees that the risk of injury is an inevitable part of playing the game at a professional level. Somewhat undermines the plan, but it's just someone's opinion, not new information. We'll have to keep checking
D. There is no scientifically valid method for determining the likelihood of any player suffering a career ending spinal injury at any given time. If we don't know who's at risk, there's no way to ban the right players! This completely undermines the plan
E. Players barred from playing because of this new regulation will be entitled to compensation for lost wages at a level determined by the commissioner’s office. Doesn't undermine or support the plan, just provides more details about it
