Although all new companies attempt various forms of alternative dispute resolution, a company's emphasis on compromise and nondisclosure are the clearest predictor of whether a dispute will eventually end up in court

A. all new companies attempt various forms of alternative dispute resolution, a company's emphasis on compromise and nondisclosure are

Emphasis is singular and hence 'are' is wrong. Incorrect

B. each new company attempts a form of alternative dispute resolution, their emphasis on compromise and nondisclosure is

'their' correspondence with ' ARD',which is singular. Meaning also changed. Incorrect.

C. all new companies attempt a form of alternative dispute resolution: their emphasis on compromise and nondisclosure is

Same error as in B. Incorrect.
D. each new company attempts various forms of alternative dispute resolution, the emphasis on compromise and nondisclosure of each company is

This changes the meaning. As if the compromise n nondisclosure is of the company however the emphasis is by the company. Hence incorrect.

E. all new companies attempt various forms of alternative dispute resolution, a company's emphasis on compromise and nondisclosure is

Maintains SV agreement and conveys proper meaning. Correct.

There are two things that predict whether a dispute will end up in court or not - they ARE - a company's emphasis on compromise and the company's emphasis on non disclosure. Company's emphasis on compromise and non disclosure is not one thing. The meaning changes as in legal disputes, compromise and non disclosure are two separate things
