The H-1B lottery was introduced in 2007, when applications started far exceeding the 85,000 annual cap (65k regular + 20k US master’s cap).Before that, visas were issued on a first-come, first-served basis until the cap was hit.Now, because 400k+ registrations often compete for 85k spots, USCIS runs a random lottery.

ith $100k pricing, it’s hard to imagine all 85k seats being filled just through random lottery.The lottery disappears (since far fewer than 85k apply)

In my circle, I notice a kind of “after me, close the door” attitude among some H-1B folks in AEC. With the talk of a $100K H-1B rule, they see it as something that would reduce competition, create scarcity, and boost salaries for those already here.

That’s basically pulling up the ladder. All went through the same struggle, so cheering for barriers that would shut out the next wave of talent feels unfair and shortsighted. Immigration rules shift fast, and the same logic could easily be turned against today’s H-1Bs tomorrow.

they better be earning more then 150k assuming the wage cap applies retrospectivly and the vast majority of H-1bs outside certain professions dont

People often underestimate how hard $150k is right after an MS (outside SF/NYC/Boston).
Yes—$150k base is doable for some engineers (especially software and a few niches), but it’s above the norm for most roles and locations. Hitting that number typically takes one (or more) of the following: a top-paying metro, seniority, or a niche/high-premium industry

yes from MBA i count only consulting and IB paying more then that in base pay i dont think bonuses will be considered in cap which is what pushes comp above 150k at say amazon]

pthways starting is 140k base and PM is rare even at amazon now without prior experience at tech unlike post covid

Even in Texas (the second-biggest H-1B state), $150k base is a stretch for many engineers.

doordahs pays 100 to 140k Total post MBA same with Uber and outside tech no one hires H-1bs and now after 100k fee definitly wont all other industries in severe recession anyways with big net job losses this year

It will take a few months to formalise and then it will be clear if they place a wage cap and at what level

Making it easier to decide if R2 application worth it or not

So they're gonna still keep the lottery, but instead of a flat lottery, it will be a wage-weighted lottery.

For example, currently, everyone has the same chance:
85,000 (H1B Cap) ÷ 500,000 (registrations) = 17% chance per registration.

the new DHS proposal

Under the proposed system, each registration gets “tickets”:

Level 1 (Lowest level) = 1 ticket (one lottery chance), L2 = 2 tickets, L3 = 3 tickets, L4 = 4 tickets

In San Francisco, the same occupation looks more like:

L1 ≈ $110k
L2 ≈ $140k
L3 ≈ $170k
L4 ≈ $200k+

How are they gonna decide which level you fell, that's decided by the Bureau of Labor

BOL has an occupation code for each job and city code, based on that they decide which level you fall

For example Dallas–Fort Worth MSA (2023 Software Engineer)Level I: ~$65,000 (Applicant will get one chance)
Level II: ~$82,000 (Applicant will get two chances)
Level III: ~$99,000 (Applicant will get three chances)
Level IV: ~$117,000 (Applicant will get four chances)

Where did you get these details from? Also that's confusing I mean will there be a limit as to how many ppl can be from each industry?
