If the other party was clearly at fault, you should handle it entirely through their insurance company (hopefully they were insured). If you do that, it may never get back on your own record that you were in an accident (at fault or not).

If you go through your own insurance company, they will handle the process of recovering from the other side, but they will surely note it on your record and raise your rates.

This is not entirely true. If the DMV/police report records that you were not at fault for the accident, then irrespective of what your recovery process is, a direct claim to the other party's insurer or a subrogated claim through your insurer, most insurance companies will not raise your rates. I say most only because I am not proficient with the insurance laws in Illinois. My observation is based on CA laws.

We shall see, but Gieco pretty much assured me my rates would not increase.

The damage really doesn't look too extensive. A new front airdam and light + blinker shouln't set the guy back more than a grand or so, including new paint. If I were him I'd just pay for this out of pocket. Are you still driving the car around or using a rental? Any police report filed?

Its not too bad. The car couldnt be driven away because the bumper, along with a good chunk of metal got slammed into the tire. Geico put the estimate at $2,000 total. Don't have a rental, but I need one. We filed a police report but the police officer was a total prick and didn't ask us a darn thing. He didn't discuss fault, take any real statements, or issue any tickets. Thats the only part that worries me - that the police officer will come back and file a report placing me at fault as I was making a left... cause he really didnt bother to get a statement from either of us.

He was being so abrasive and outwardly unfriendly... You got the feeling that if you pissed this guy off or made him work hard, he might just haul you into jail on some trumped up charge. I've really grown to dislike the cops in this city.

Late to the thread, but oh that sucks!

I had to think back on the dates -- I was afraid that that might have happened after you dropped me off. At least my visit wasn't related!!

Get something fun for a rental.
