Let's look at the options one by one-

A- and that the information is not parallel with anything below the underlined part of the sentence.

B- Same as A.

C- tips is plural, but was is being used to refer to tips.

D- shared the information - department of labor will soon order and shared the information is not parallel.

E- Seems right. information is referring to whether branches confiscated tips and there are no parallelism issues.

Hence, IMO E.

(A) earned by their employees and that the information be shared
The passive construction “earned by their employees” makes this choice wordy.

(B) that their employees earned and that the information be shared
This choice has no errors. The use of subjunctive (in green) correctly pairs with the verb “order”. This is likely the correct answer. – Contender.

(C) that was earned by their employees with the information being shared
The phrase “with the information being shared” is wordy and awkward. Usually (and not always!) the choice having the word “being” is not preferred by GMAT and we must look out for another option with a more concise and to the point grammatical construction.

(D) earned by their employees and shared the information
The passive construction “earned by their employees” makes this choice wordy. Also, the original sentence intends to tell that the “the Department of Labor will soon order the information (received) be shared”. Option D distorts the intended meaning of the original sentence.

(E) earned by their employees, information that must also be shared
The word “also” here is unnecessary and completely changes the intended meaning of the original sentence.

Answer: Option B

Two instructions are given by the department of labor. Order is a subjunctive verb that requires the use of "that". So Eliminate C,D,E.

(C) that was earned by their employees with the information being shared
(D) earned by their employees and shared the information

--> put two subjunctive orders in parallel "to investigate.." and "that information be.."

(B) that their employees earned and that the information be shared
--> Ambiguouity about two clauses are parallel or not, and if "their employee.." and "information .." in parallel that is illogical

(C) that was earned by their employees with the information being shared
-->tips are plural so need a plural verb in the modifier

(D) earned by their employees and shared the information
--> put "earned" and "shared" in parallel which is not logical

(E) earned by their employees, information that must also be shared
--> these two clauses are connected with just a comma, not correct

We already have a fixed imperative structure in the original sentence: order + TO DO sth. That means that, in order to adhere to the parallelism regulations,
we need to have the same structure regarding the information: order + TO SHARE the information.

Interestingly, the subjunctives used in A and B are wrong as they are non-parallel. Also, option D is wrong because of the sudden past tense.

Finally, we have a split between C and E. We immediately see that C is wrong, because it says <tips> that WAS earned, regardless of the plural form.
Therefore, we eliminate C, and the right answer is E.

Option A : 'order to X and that the information BE shared' is correct and properly brings out the subjunctive mood.

Option B, C, D, E : meaning of the 'information' changes and creates ambiguity
