Following multiple reports of wage theft, the Department of Labor will soon order a national restaurant chain to investigate whether several of its branches confiscated tips earned by their employees and that the information be shared with the local restaurant workers’ unions.
The DOL will order a restaurant chain to investigate
1. whether several of its branches confiscated tips
2. shared information with the local unions.
It is unclear who shared the information to unions (is it the restaurant chain's branches or the restaurant chain itself ?)
So the sentence maybe corrected grammatically either by:
The DOL will order a restaurant chain
1. to investigate whether several of its branches confiscated tips
2. to share information with the local unions
(or by)
The DOL will order a restaurant chain to investigate whether several of its branches
1. confiscated tips
2. and shared information with the local unions
But though this option has parallelism between 'confiscated' and 'shared' there is no connection between the two( each events happening independently and is illogical to meaning) and because of this it is unclear what information is shared with the unions.
(A) earned by their employees and that the information be shared
Here the parallelism is at problem. Between 'will order to investigate....' and 'will order that information be shared' you see that 'order that....be shared' is command subjunctive and breaks the parallelism. Eliminate
(B) that their employees earned and that the information be shared
Same parallelism with as in option A. Eliminate
(C) that was earned by their employees with the information being shared
tips is plural. 'that was earned' uses singular verb, which causes Subject verb disagreement. Eliminate
Also, it seems that the employees earned the tips with the information that was being shared and cause meaning issue. Eliminate
