Which court?? The court owned and dominated by Republicans?
Law firms are saying it doesn't apply to those going from OPT to H-1B so we might be safe for now

Guys I think many of us are subconsciously fear mongering. The healthy way to deal with it is just wait a couple of days till more details emerge

No need to erect a tombstone to the dream, just yet

This doesn’t affect people who are on F1 and applying for an H1B. But if you wanttakesnter the country on your H1B you can be stopped if your employer hasn’t paid the 100k fee. This effectively means you can’t travel in and out of the country. If you are in the US already it won’t be a problem. This isn’t ideal because obviously one would want to travel back and forth to see their family etc.
if this stands then it’s a negative for anyone hoping to work long term in the USA.

However, it’s highly likely to be struck down by courts.
It was deliberately announced on a Friday evening to spread panic over the weekend since nothing can be done in court until Monday. The headlines are there, the panic is over the weekend, the voter base is appeased. But for it to stand legally is a whole other challenge.
In any case, let’s wait and watch. There will be influencers who will milk this by releasing a ton of videos and posts on LinkedIn. But let it takes its course.

This is a message that my consultant sent me. And I think sums up the situation pretty well. So don’t worry guys, just let this whole situation play out.

We are all in this together and we will all support each other.

Legally what does it violate exactly? They’re not gutting the program or discriminating, just increasing the fees which is likely under the ambit of govt/usics

So I’m just keen to understand where the “not legal” aspect is

I am not sure. But you are missing the point. Let’s not worry about things we don’t fully understand yet

Let’s not spiral on this one update—facts are still unfolding. Big picture though, Trump-era immigration policy is volatile: today one rule, tomorrow another. The smart move is to treat that uncertainty like hedge funds do: their models assume human irrationality and policy swings as part of the system.

For us, that means planning with our risk appetite in mind and pre-deciding the worst case: if the harsh scenario happens, am I mentally and practically ready? Build buffers—time, money, documents, or backup schools/countries—so volatility doesn’t derail your long-term plan.

Let’s proceed on the basis that policy swings continue. We’ll treat that as a given in our plan—just like systematic models do

Nothing is stopping USCIS to issue i797b and forcing F1 to H1 change from outside the country.

There are two ways to change the status,
one i797a, status changed in the USA without leaving. What people usually do.

Second i797b, consular processing, to activate the status, you have to leave the country, get stamp, and enter again.

If admin really want to use the proclamation, they will start issuing i797b instead of i797a.
