Of course they are illegal, but it doesn't stop admissions committees from doing it. The want to add diversity (for various reasons - some honorable, some questionable) and matching up similar applicants with similar diversity characteristics together is reasonable. Think of it as picking the best few from a group of consultants and then letting the rest wait to see which consultants come in R2.
Also, it's unlikely that the suit will succeed. Admissions decisions are "holistic". They would need specific proof that Harvard was discriminating against Asians (memos, habitual practices, witness in the admissions process, etc). It will be a very hard standard to prove.

The Harvard lawsuit will go nowhere. There is no way to prove that any applicant "deserved" a spot over another applicant. Harvard themselves concede that they can build as strong of a class as one they admit from all of their rejections. There is too much in play to really say "hey, I didn't get in because I am XYZ".
I think the whole race thing is overblown. They obviously don't want a class with the same profile, since they'd be adding very little to the classroom experience (in theory) and many would be going after the same jobs and goals. That's not a great environment. I really don't think a Chinese Investment Banker pursuing a Finance career and a Chinese Engineer pursuing a tech product management role are put into the same group of applicants. These are vastly different profiles.
That's why it's so important to focus on fit instead of rankings. The majority of the applicant pool of the top 15 schools are qualified for a seat in the program; the question is who is a better fit.

I agree with many of your points. However at the end of the day you cannot have all Chinese or Indian applicants in the class irrespective of the fact that how different their profile is and there would definitely be a cap on number of students from a particular country. Yes this does intensify the competition in a large applicant pool and it may not be fair but that's life. At the end of the day I believe peer diversity definitely improves the overall MBA experience.
