We are left with B and E.

Choice E distorts the means - “take collective action, or improve their”. The actual meaning is “take action to improve their working conditions”.

So i thinks, choice B is correct.

The correct sentence reads:

The Massachusetts Department of Labor Relations requires the state’s over one hundred thousand private employers to display its union rights sign, which informs employees of their right to join or form a union or to take collective action to improve their working conditions.

The Department of Labor does only one thing - "requires the state’s over one hundred thousand private employers to display its union rights sign".

Subsequently, "the sign" informs employees of their right to 
1) join or form a union

OR

2) to take collective action to improve their working conditions

This portion is of the simple form X or Y, where X itself is of the form (A or B). Therefore, the total clause reads (A or B) or Y, where:

A = join a union
B = form a union
Y = take collective action to improve their working conditions
