Public Notice Official GMAT India : Circulation of False Messages

Question

The notice has been updated by the GMAC:

Owing to infringement of its copyright protected material and circulation of false and misleading messages, GMAC had filed a commercial suit on 22 November 2019, before the Hon’ble Bombay High Court, Mumbai, India, against Mitul Gada & Associates and Mitul Gada [titled: Graduate Management Admission Council v. Mitul Gada & Associates & Anr. | Comm. Suit (L) No.1250 of 2019].

Pursuant to filing the suit, GMAC, Mitul Gada & Associates and Mitul Gada have executed consent terms on 10 December 2019 which have been made part of the order and decree dated 11 December 2019, passed by the Hon’ble Bombay High Court. As part of the consent terms, Mitul Gada & Associates and Mitul Gada have tendered an unconditional apology for their wrongful acts and have undertaken:

(i) Not to infringe GMAC’c copyright protected publications;

(ii) Not to hold out or represent themselves or their services to be GMAC or otherwise claim to be affiliated to or associated with GMAC and/ or the website/ domain name https://www.mba.com, through any modes of communication;

(iii) Not to impersonate GMAC including by creating fabricated and concocted messages that appear to be sent from GMAC, through any modes of communication;

(iv) Not to defame GMAC, through any modes of communication;

(v) To permanently delete all content from their books, study materials and any other materials containing any of GMAC’s content or copyrighted works from their websites and other digital platforms;

(vi) Deliver to GMAC all of their DVDs, books, study materials and any other materials containing any of GMAC’s content or copyrighted works;

(vii) That they do not possess and have not retained in their possession, custody or control, any material that contains any of GMAC’s copyrighted works or part thereof; and

(viii) Pay damages to GMAC as well as compensation for GMAC’s legal fee.

It had to be bad. 
GMAT even mentioned all the details about the Fraudster. So someone must have complained and the limit is using the mba.com handle for text messages.
Claims "that it is “associated with the GMAC Council” and is supporting GMAC to enhance “the quality of administration and test questions”. are Nasty to lure the students into their trap. GMAC had to do something to be safe and to save applicants from such people.

In this specific case, however, I partially blame also the students.

They should activate their brain not only to solve GMAT questions but also for this kind of misleading companies.

I had contacted GMAC almost 6 months back informing them of such activities by mitulgada. I did not receive any reply from GMAC.

Great that they have come forward with this release.

I think they usually get data from the contact details shared with other test-prep companies during MBA fairs.

I base my assumption on the fact that I never got email communication (as I never share my actual email id) but i did share my contact number - ONCE!!!

How these people do such things?
you can even see reviews from different accounts. recently few of them posted reviews regarding his false claim.

Case closed, Bombay High Court verdict is out and such fraudulent companies need to worry now. GMAT has updated their website for our benefit.

GMAT filed the case on 22nd Nov and apology came out on 11th Dec. i am sure compensation paid out to GMAC is hugh but i can not find the order by Judge on Bombay High Court website, but case indeed was filed and apology tendered.

I had also heard of this earlier. But when I checked it from a close friend of mine who also happens to work with GMAC India (Delhi Office) he told me that the inside story is that one of Mitul Gada's competitors managed to hack his email accounts and sent unauthenticated emails & msgs just to legally frame him & malign his reputation. Something they probed later on with some forensic help. Hence GMAC has now closed the case amicably signing some consent terms in Dec 2020.

Also a couple of my cousins had been his students earlier and when asked they had very great regards for him as far as the GMAT training is concerned.

And come on guys, copyright infringements & plagiarism is one of the most common things in India, especially among coaching classes. Just that this time someone intentionally used it for some negative publicity.

And what abt those coaching classes (big commercial brands) who dupe students with fabricated testimonials, tall claims, fake ads, substandard quality, etc. What good have they done in all these years?!

Just because these things are not covered under any legal clause, students don't see much problem with them. Weird.

Who was that close friend and where do we verify that you are not one of Mitul Gada's fake accounts trying to justify the actions.. Provide a legit source where it is mentioned that he was framed
