The number of Indians who became permanent residents in Canada increased from 39,340 in 2016 to 85,585 in 2019, a rise of more than 117%, according to a National Foundation for American Policy analysis of Immigration, Refugees and Citizenship Canada data. “Canada is benefiting from a diversion of young Indian tech workers from U.S. destinations, largely because of the challenges of obtaining and renewing H-1B visas and finding a reliable route to U.S. permanent residence,” said Peter Rekai of the Toronto-based immigration law firm Rekai LLP, in an interview. Canadian policies allow for international students to make a smooth transition to work after graduation, which creates a path to permanent residence.

I really don't know why ANYBODY would want to come to US from India unless you are going to an Ivy League or have full financial aid.

Apart from what souvik101990 mentioned, how can you undermine the quality of education that one receives from top B-School programs (not just the Ivy league)? One must be realistic in his/her approach. The international experience, the diverse cohort and the network that one creates over these years is unmatched. I do agree there is a financial pain in the initial years of your career but looking at the long-term, it is worth it.

I believe because there are many people who have always dreamed of working and getting the dream job in the United States. Yes, they take a great risk, but so do other people who have made significant progress in their lives.
Canada is, of course, more liberal about immigration and it is seen by people as a safer choice considering the current situation in the United States.

souvik101990 is here since what 2/3 year? He hasnt gone through the pains of H1B lottery/extensions, PERM labor/DHS background checks, revoked offers because some moron in USCIS bans H1B Premium processing randomly etc. We'll check back with him in 5 yrs when he's in 100 yr Green Card wait as well :-)

So here's my take:

1) In general, a majority of people who get their H1B with a non advanced US degree are from few major Indian IT Firms. These IT firms hire from the Indian colleges which are among the lowest ranked in India and claim that these employees posses 'Special Knowledge'. In my experience most of what 3 of these people do could be done by a single person. I don't hold anything against people but the companies in general they charge a lot (200K$) from big banks and other corporations and only pay a meagre sum to their employees even on H1B. The reason people go for these jobs is because in India they are paid about 4-5K$ and in US they are paid 70-100K$ which is a big jump and the quality of life is better in general and they have to struggle less which makes sense. IMO these IT firms should never have their H1Bs approved unless they actually bring in real talent but they get away by hiring not so good candidates because no one cares (yet).

2) Now, let's understand who goes for MS from India. These are not the people who I mentioned in Para 1. I dont have the actual numbers but in best case scenario I would assume about 20% of people going FOR MS are from Tier 1 colleges (read IITS) and rest 80% from Tier 2. Based on my experiences, I would assume that these have an edge over an average American because at some point in their life they have had access to a much better and focused mathematical and science curriculum. I still have my doubts about if all of these people deserve an H1B but I think a lot of these do.
I think why people are so concerned about OPT is because a lot of people from Tier 2 colleges in India have to struggle in their initial career and going to US is a smart choice which would then put them into dilemma if OPT is taken away.

I think if they can solve the problem mentioned in my point 1 and be more rigorous about whom to award H1B with, we wouldn't require an extensive OPT program. I am not very familiar with the MBA STEM program yet so I would refrain from commenting on those lines.


I would suspect that there is a major lobbying that has been happening and hence the problem.

Problem is very simple, US gives out around 1.2M green cards every year, ONLY 14% of those are allotted to Employment Based (EB) Category, rest go to family members, Asylum seekers, diversity lottery (BTW India, which is the most diverse country in the world is NOT qualified for diversity GC, one more example of insane immigration system) etc. They need to reverse that, attach GCs to diplomas of grads from Top 100 US schools. Make it 50/50 (EB based vs others).

As for H1B, it's simple too. Remove lottery system, give preference to candidates who earn more and/or that have attended again Top schools. If they do these 2 things, there will be no need of OPT and other shady programs.

BUT there's a group called "American Association of Immigration Lawyers", they dont want America go on that path of Merit Based Immigration, they love this backlog as it brings more money from them.

There are 500k people in green card backlog, who was just one layoff away from losing everything. All of them are legally in the US for more than 10 years and a lot of them have Masters degrees from top US schools.

But I was wondering how all this plays out for people who want to get up the ranks faster (let's face it, it's a pain in india) and return home (once they pay off their loans and have decent savings) post working for 5-7 years. How restrictive would the H1 be in that case? I'm sure not everyone wants to permanently settle in the US.

Whilst things are looking increasingly disturbing for the international student, I'd say it's best for us to wait for the official announcement to come out. Hopefully it's not as bad as it seems at the moment.

I remember reading some place about the announcement bring made by mid July

How do you think Lawyers will profit from a suspension of the H1B program? Seems like removing a cap would be the best thing for them...

Immigration system is MORE than just H1B.
What is happening in WH right now is just noise - created by the likes of Miller as elections are near. Real issue is allotting visas and green cards via lottery - brings more money for lawyers that way. 400K people file for H1B, only 65k get it but all pay lawyer fees. Indians/Chinese in green card backlog so more fees to get H1B extensions for lawyers.

We dont need lawyers for legal immigration, Canada has proved it. We just need a good website, and merit/point based system. But again, lawyers oppose that - if that happens who will pay for their 3rd home in a Colorado ski village?

Staphyk American politicians get high on the best out there, you need to get into US senate for that. There's a guy named Dick Durbin, who is in Senate since 1996, he regularly gives speeches about immigration about how much he cares about us, but when it came to passing an immigration bill, he blocked it single handedly. Why, you ask? He was paid around 2M in campaign contribution by AILA in 2018-19 (immigration lawyers association).

So yeah, I stick to my point, you are a talented immigrant, and have $100k lying in your bank account - better spend it in Canada, at-least they won't treat you like a 3rd class citizen.
