Only appear as makes sense.
The subpoena requires a person to come to court as a witness (and not, say, in the capacity of an observer or a juror)
ELIMINATE A
→ the plural pronoun they does not agree with the singular noun person
• appear to be should be appear as
→ appear to be means seem to be.
→ That definition makes no sense here. No one can be called to "seem to be" a witness.
ELIMINATE B
→ because a person does not appear immediately after the introductory phrase and comma, we have a dangling modifier
ELIMINATE C
The intro phrase implies that the subpoena itself is being asked to appear in court.
That implication makes no sense. From the other sentences, we can tell that a subpoena is the summons that orders the person to appear in court.

My answer is (E). It took me 01:25.
(A) "like a witness" is incorrect.
(B) "they" does not agree with "a person"
(C) "it" cannot be the logical subject for verb "receive a subpoena".
(D) "A subpoena is received to appear in court as a witness" is nonsensical: a subpoena cannot appear as a witness.
