This sentence is not correct and illogical. You should first know how verbing words work. Verbing with a comma ( except "including") always describes the action. And in active voice The subject should make sense with modifying entity. In this sentence is illogical because it says: He is showing that he is guilty. But we know logically that the action of not producing any evidence is showing he is guilty. The fact is the subject here and shows should be the verb for it. So it should not be seperated by a comma. So this sentence is also wrong. No it’s not a modifier.
