Sorry about the issue. I have not heard of this loophole. I hope it works.
The finger-pointing is classic. Any issue that happens seems to require some input from GMAC and when you contact GMAC it also seems to require some input from examity. Giving a perfect opportunity to both parties to have an endless loop that is hard to break.
I have not heard about opportunity to cancel the test and not pay a fee. The rest of us slobs here in the US have to pay the fee I’m not as lucky as some of the European protections you have for airlines and other industries. I probably would not hold your breath to get a free cancellation or a free reschedule but you may be able to scare them enough. In my experience however, they don’t make decisions quickly and they don’t respond quickly either 😬

Thanks for your response!
At least there is a live chat with Examity, their team is friendly and they seem to take the issue seriously. Not the case for GMAC support.
If interested, you can find the information about the fee-free cancellation on their website under mba.*** > Exams > GMAT Exam > Before the Exam > Register for the GMAT Exam > Manage Your Appointment > Is Your Test Center in the European Union?
There it says:
Quote:
If testing within the EU, full refund is provided if the appointment is canceled within 14 days of the registration date. Please contact GMAT Customer Service by phone at +44(0)1618557219 or live chat via mba.***.
Also, there is some more information about the rescheduling / cancellation fees and deadlines for other parts of the world.
You are right - the consumer rights in the European Union and especially in Germany are a huge advantage (for the consumers, not the companies).
Actually, I should charge them a fee for pointing out a legal risk in their system (and hopefully forcing them to fix it).
I'm pretty sure that I would win a lawsuit against them but I have some hope left that we will find another way to sort this out.
I'll keep you updated.
