Isn't "declaring that" a subjunctive and hence needs an infinitive?

Apparently not as neither A) or C) are correct. Can someone please elaborate?

C has a clear subject - verb agreement error.

Read C: their advocacy [Subject] for ordinances that mandate fees on plastic containers prevent [Main verb] -- it should be prevents because advocacy is singular.

Hope this helps.

"that " is actually not referring to anything. even if we look for nearest noun(ordinances) it makes no sense at all.
Quote:
B mandating fees on plastic containers is preventing

no pronoun error is removed and meaning is correct.
rest of the choices are easy to remove.

A mandating that fees be on plastic containers prevent - *that* is wrong here. Infinitive firm also not required.
B mandating fees on plastic containers is preventing -hold
C that mandate fees on plastic containers prevent- that is unnecessary
D to mandate fees on plastic containers are preventing - again SVA error.
E to mandate fees on plastic containers is preventing- hold
Between B and E, the infinitive form is unnecessary as it is used when we need to present the purpose or the intention of an action. This phrase is actually a shorter way of “writing” “in order to verb”. Not the case here hence B.
Hence ans is B

A mandating that fees be on plastic containers prevent -redundant & wordy
B mandating fees on plastic containers is preventing - correct (sva)
C that mandate fees on plastic containers prevent - incorrect sva (prevent is plural but subject advocacy is singular)
D to mandate fees on plastic containers are preventing - svae
E to mandate fees on plastic containers is preventing -- to not required

We are using "mandate" out here which is subjunctive verb. And subjunctive form comes in below form only,

Subjunctive clause+ that + S+V+O
So, out here usage of that is mandatory.
Under same option 1 should be only correct answer as that only follows this standard.
Would someone pls elaborate why we have diverted from very standard rule.

This question is derived from an OG question:

B. requiring turtle-excluder devices on shrimp nets is protecting
C. that require turtle-excluder devices on shrimp nets protect
D. to require turtle-excluder devices on shrimp nets are protecting
E. to require turtle-excluder devices on shrimp nets is protecting

Can you please elaborate on why you think that this is such an important pattern and perhaps highlight the special structure?

Thanks in advance :-)

C has a clear SV agreement problem, ‘advocacy; is singular but ‘prevent’ is plural. ‘Fees be on’ is very awkwardly constructed. So A should not be considered. D has SV agreement problem too, ‘advocacy’ is singular ‘are’ is plural. ‘to mandate’ in E is improperly constructed, so B is the right answer.

shouldn't option E be preferred over B?
As we prefer to+verb over verb-ing

Shouldn't there be a comma after ordinances for option B to be true?
