the which refers to performance, but which has to refer to the noun directly before, therefore, this phrase has this mistake??

Yes you are right. Relative pronoun modifier 'which' refers to the closest noun, However, there is an exception to this rule. If there is a prepositional phrase giving additional information about that noun and which cannot be placed anywhere else in the sentence, This structure is acceptable.
Structure of the exception goes like this- Nounadditional information about nounRelative pronoun modifiers
Remember that additional information about noun should not result in ambiguity and cannot be placed anywhere in the sentence for this exception to work

There is nothing like exact rules-it's all about the meaning issue. Here you go for the examples: 1/ The old capitol building in Benicia, which was the capital city of California, is a historic landmark. ^^ which modifies noun only.
2/ The old capitol building in Benicia, which was built in under a year when the city was designated capital of California, is now a historic landmark. ^^ which refers to the noun+prepositional phrase Thanks__
