Hi kdg13, I think you should apply in R1 without TOEFL. I would recommend that you write in the additional essays section your reasons for waiving the exam.
If for some reason the adcom requires that you take it, they will inform you and you can just take it before R2.
I don't think they will nullify your application because of a missing TOEFL exam.
